Case reopened against Mayor for not taking down pro-independence flag

The case against Montse Venturòs, the Mayor of Berga, for not taking down the Catalan pro-independence flag from the City Hall building during elections has been reopened. Although Berga’s trial court decided not to pursue the case last March after considering that exhibiting the Catalan pro-independence flag was not “an act of propaganda” nor disobedience, the court has now accepted the appeal presented by the Public Prosecutor asking for the case to be reopened. Venturós lawyer and party colleague Benet Salellas from pro-independence CUP said that reopening the case proved “how deeply politicized the Spanish justice is and how legal procedures are the main battering ram against the pro-independence movement and the democratic demands of Catalan citizens”.

Parliament says Government should seek Venice Commission’s endorsement for referendum

The Catalan Parliament called for the Government to “launch the necessary actions to obtain the advice, recognition, and endorsement of the Venice Commission with respect to the conditions that the referendum should fulfill in order to meet the requirements established by this body”. The Catalan Chamber also agreed to ask the Catalan executive to inform the Commission of the Catalan people’s desire to call “a referendum in agreement with the State”. This point was approved thanks to the votes of governing coalition Junts Pel Sí and the alternative left coalition Catalunya Sí que es Pot. However, the members of the other pro-independence party in the chamber, the radical left CUP, abstained from voting, since they believe that the possibility of reaching an agreement with the Spanish State regarding the referendum is not realistic.

50% of Catalans support calling a referendum without Spain’s permission

Latest polls say 50.3% of Catalans want to call a referendum on independence regardless of whether the Spanish Government agrees. Indeed, if both parts fail to reach an agreement and the consultation takes place anyway, 43.3% would vote ‘yes’ to Catalonia’s independence. Another 22.2% would vote ‘no’ and 20.7% would abstain, according to the latest poll by the Center for Opinion Studies (CEO). In response to whether they would like to simply like referendum to be held in Catalonia, 73.3% of the surveyed answered ‘yes’. The CEO also noted that governing coalition Junts Pel Sí would win the Catalan elections again if they were held today. However, their influence in the parliament would decline from the 62 current MPs to 58 or 60. The other main pro-independence party in the chamber, the radical-left CUP, would also lose 2 MPS.

Parliament passes 2017 budget, which foresees allocation for the referendum

The pro-independence parties in the Catalan Chamber, governing cross-party ‘Junts Pel Sí’ and radical left CUP have passed the 2017 budget. The bill has been described as the last budget of the autonomic period, since it foresees calling a referendum on independence next September. Last June, CUP refused to pass the bill for 2016 which led to the vote of confidence promoted by Catalan President, Carles Puigdemont. They considered the numbers presented then to be “too autonomic” rather than responding to the pro-independence aspirations of Catalonia. After a new draft was presented last November, increasing the social expenditure and reinforcing the government’s commitment to call a referendum, CUP have accepted the bill. However, they have urged the Catalan Government to announce the date and the question of the referendum as quick as possible.

Catalan Government to keep referendum date despite TC suspension

The Spanish Constitutional Court (TC) has definitely suspended the governing party ‘Junts Pel Sí’ and radical left pro-independence CUP joint proposal to call a referendum in 2017. A decision which, according to Catalan Government Spokeswoman, Neus Munté “was not surprising” not even at “this extraordinary speed” and culminating “a tense week” during which the 9-N trial over symbolic vote on independence took place at Barcelona’s High Court. However, she assured that the ruling “won’t change the Government’s determination to call a referendum this year”. Munté emphasised that the joint resolution “was discussed and voted on by the Catalan MPs in accordance to the freedom of speech” and that these MPs were “democratically elected”. In a similar sense, CUP MP Benet Salellas warned that his group “will guarantee that the referendum takes place, regardless of the TC’s wishes”.

Government “can’t continue” without passing the budget, Puigdemont warns

Catalan President, Carles Puigdemont, insisted this Thursday on the importance of passing the budget for 2017. If the bill, which will be put to vote in February, doesn’t receive the required support in the Catalan Chamber, “the Government can’t continue, for reasons of dignity and democratic coherence”, Puigdemont stated. Thus, he called for pro-independence radical left CUP, the main partner of cross-party list ‘Junts Pel Sí’ in the Government to have “courage” and allow the bill to be passed. CUP already vetoed the previous budget last summer, forcing the extension of the 2015 budget, after considering it “too autonomic” and not proper of a state which aims to be independent.

Joan Coma testifies before the Court for defending “civil disobedience” in a plenary session

Joan Coma, a pro-independence radical left CUP councillor in Vic, a town 60 kilometres from Barcelona, was arrested on Tuesday for ‘insurrection’ when calling for disobedience against the Spanish institutions in a plenary session a year ago. Two police officers in civilian clothes took him to Madrid’s ‘Audiencia Nacional’ court, where he had to declare this Wednesday after refusing to do so in October. Coma was freed without charges but the magistrate Ismael Moreno asked for the removal of Coma’s passport. “I hope to have a Catalan one soon”, Coma stated before the press soon after leaving the ‘Audiencia Nacional’ court. Hundreds of representatives from CUP, pro-independence left wing ERC and the Catalan European Democratic Party PDeCAT showed their support for Coma on Wednesday before many city halls throughout Catalonia and before the ‘Audiencia Nacional’ court.

Spanish Court suspends Parliament’s plan for pro-independence referendum

The Spanish Constitutional Court (TC) has temporarily suspended the proposal approved by governing cross-party list ‘Junts Pel Sí’ and radical left pro-independence CUP to call a referendum in Catalonia. The magistrates admitted this Wednesday to proceed with the appeal presented by the Spanish executive in October, which calls for the suspension of the pro-independence group’s proposal approved in the Parliament and considers it to have emerged from the previously suspended declaration to start launching the pro-independence roadmap. The TC judges have also warned Catalan President, Carles Puigdemont and Parliament’s President, Carme Forcadell that they must avoid any initiative aimed at contravening this suspension. The TC decision arrives only two days before Forcadell is due to testify before the Court for allegedly violating the Spanish Constitution when allowing the pro-independence debate to take place in the Catalan Chamber, last July. 

Five pro-independence activists to testify for burning pictures of Spanish King

The five pro-independence activists who burned pictures of the King of Spain will testify on Tuesday at 9 am (CET time) before Spain’s High Court, the ‘Audiencia Nacional’, in Madrid. The Catalan Police Force, Mossos d’Esquadra, has already arrested three of them and will detain the remaining two and hand them over to the Spanish Guardia Civil during the course of the day. Mossos d’Esquadra acted following the orders of the Spanish Court. The judge investigating the five people for an alleged crime against the crown, Fernando Andreu, decided to order the arrest after those activists who are now to be prosecuted refused to testify by videoconference last Wednesday. This case fuels once again tensions between the radical left pro-independence CUP and the governing cross-party list ‘Junts Pel sí’ (JxSí) over the action of the Catalan Police Force. Indeed, CUP has already announced it will request the resignation of the Catalan Minister for Home Affairs, Jordi Jané, for allowing Mossos d’Esquadra to be subordinated to the Spanish courts.

Summit to organise independence referendum to be held on 23 December

The Catalan President, Carles Puigdemont, has summoned the members of the National Alliance for the Right to Self-Determination to meet on the 23rd of December to start organising the referendum on independence. The summit, in compliance with the resolutions adopted at the general policy debate in October, will be chaired by Puigdemont and the President of the Parliament, Carme Forcadell. As sources close to the presidency have told the Catalan News Agency, the meeting will be held in the Parliament just after it has given green light to the 2017 budget. The aim of the meeting is to find political and social consensus around the organisation of the referendum to be held next September 2017. According to the Spanish Government spokesman, Iñigo Méndez de Vigo, the meeting is a “symptom of unilateralism”, resulting from requests from “the radicals of the CUP”.

Pro-independence parties present motion against prosecution of Catalan Parliament President

The cross-party coalition 'Junts pel Sí' (JxSí) and the pro-independence radical-left CUP entered in the Catalan Parliament’s register a motion to defend the Parliament’s President, Carme Forcadell. The representative is facing criminal liability for allegedly disobeying Spanish Constitutional Court (TC) rulings and allowing the pro-independence roadmap to be put to vote on the 27th of July. According to the text presented by the pro-independence parties, the prosecution of Forcadell “for any parliamentary action flagrantly infringes upon parliamentary inviolability”. Furthermore, the proposal highlights that the criminalisation of parliamentary activity “poses a serious threat to democracy”. The motion was entered into the Parliament’s register on Monday as an urgent extraordinary request and with the express request to debate it in a plenary session. The text also aims at defending “the freedom of expression and the right of initiative of the members of the Catalan Parliament”.

Puigdemont questions Spain’s willingness to dialogue as it doesn’t include bilateral negotiation with Catalonia

The Catalan President, Carles Puigdemont, is suspicious regarding Spain’s executive willingness to dialogue. During this Wednesday’s session of control in the Parliament, Puigdemont stated that Catalonia deserves a bilateral negotiation with the Government in Madrid and that he considers anything other than this a way to “dilute and disguise what is really going on” in Catalonia and therefore “confuse public opinion”. Pro-independence radical left CUP MP, Mireia Boya, went a bit further and urged Puigdemont not to go along with Spain’s “siren calls” in relation to its supposed openness to dialogue. On the other hand, Xavier García Albiol, the leader of the Catalan branch of Spain’s governing party PP, called for Puigdemont not to be like “a statue” before the “signals” sent by the Spanish Government. 

“The time of cutbacks is over”, says Catalan Minister for Economy after presenting 2017 budget

The Government’s draft for the 2017 budget was published in the Parliament’s Official Journal this Tuesday. On Wednesday, the different groups in the Catalan Chamber will be able to present appeals and the whole bill will be discussed on the 20th of December. “This is the best budget possible”, Catalan Vice President and Minister for Economy and Tax Office, Oriol Junqueras, stated right after presenting the draft. “The time of cutbacks is over”, he assured and emphasised that the budget for 2017 has been enhanced in comparison to the previous one “both as a whole and in each department”. Indeed, the budget for 2017 allocates €1.1 billion more to social expenditure than the bill for 2015 – which was extended for 2016. The Health System with €8.7 billion and Education and Universities with €5.5 billion are the areas with the highest amounts allocated.

‘Junts Pel Sí’ would win new elections but pro-independence forces could lose majority

If new elections were to be called in Catalonia today, the winner would be governing cross-party pro-independence ‘Junts Pel Sí’, which would still have between 60 and 62 seats in the 135-seat Parliament. Spanish Unionist ‘Ciutadans’, which is currently the main party in the opposition with 25 MPs would get between 15 and 21 seats. The highest increase according to a poll released this Friday would be for alternative left alliance ‘Catalunya Sí que es Pot’ (CSQP) which would get 19-20 MPs compared to the 11 seats it currently has in the Chamber. On the other hand, radical left pro-independence CUP would drop from 10 seats to 6-8. Regarding pro-independence support amongst Catalans, the poll shows a return to the tie situation which has been the most common result of the polls. Thus, 44.9% of Catalans would support independence, while 45.1% would vote against it.

2017 budget to include allocation for pro-independence referendum

There will be an allocation in the 2017 budget for the pro-independence referendum, which the Catalan Government will carry out “regardless of the situation”. Thus, the Secretary for Tax Office, Lluís Salvadó, responded to pro-independence CUP’s demands to call a referendum in 2017 even if the Spanish Constitutional Court (TC) could ultimately appeal or suspend the bill. “The Catalan Government has a univocal commitment and the referendum will go ahead”, he stated this Tuesday in an interview with TV3. “We will do it in one context or another”, he added. The bill for 2017, which received CUP’s support last Saturday, also increases social expenditure by 989 MEUR in comparison to the amount allocated for this purpose in 2015. The Government is determined to approve the budget for 2017 and bring the bill before Parliament on the 29th of November.
