Catalonia’s Public Prosecutor presented this Thursday a new lawsuit against Parliament’s President, Carme Forcadell and the three members of the Parliament’s Bureau which belong to governing cross-party list ‘Junts Pel Sí’, that is to say Anna Simó, Lluis Corominas and Ramona Barrufet. They are accused of disobedience and perversion of justice for allowing the Chamber to vote on the proposal for a referendum. However, the Public Prosecutor didn’t bring any action against Joan Josep Nuet, also a member of the Parliament’s Bureau, after considering that he didn’t aim to launch any “political project which disrespects the Constitution of 1978”. This is the second lawsuit against Forcadell presented by the Public Prosecutor and is expected to be added to her prosecution for having allowed a democratic debate on Catalonia’s independence in the Catalan Chamber on the 27th of July.

Catalan President Carles Puigdemont and the Catalan Ministers received this Tuesday the Spanish Constitutional Court (TC)’s notice informing them that the proposal to hold a referendum on independence in 2017 passed by the Catalan Parliament has ultimately been suspended. The document, which washand delivered by two judicial secretaries from Catalonia’s Supreme Court, warns the Government of the consequences they may incur if they disobey the resolution. The proposal, presented and approved by governing cross-party ‘Junts Pel Sí’ and pro-independence radical left CUP reaffirmed “Catalonia’s imprescriptible and inalienable right to self-determination” and called the Government “to hold a binding referendum on Catalonia’s independence” which would have to take place “in September 2017 at the latest and have a clear and binary question”.

Catalan President Carles Puigdemont called once again for the Spanish Government to lay their proposal for Catalonia on the table, in the case that they have one. “We do have a concrete proposal, which is clear and has been endorsed by the citizens”, he said this Monday in Toulouse, after meeting with the MEDEF Occitanie, a French businessmen’s association. “If the Spanish State has any proposal which we are not aware of, we call them to put it on the table”, he added and emphasised that Catalonia has long been willing to negotiate. The “problem”, he lamented, is that there is no one to negotiate with. Puigdemont’s statements came after the delegate of the Spanish Government in Catalonia, Enric Millo, assured that the dialogue between both governments “exists at all levels” and that the Government in Madrid “is working to find a way out” of the political situation in Catalonia.

Spain’s Constitutional Court (TC) has approved the appeals presented by Spanish Unionist ‘Ciutadans’, the Catalan Socialist Party (PSC) and the Conservative Catalan People’s Party (PPC) in November in relation to the pro-independence declaration approved by the Parliament. The three parties presented writs of protection and considered that the pro-independence forces’ agreed declaration to start building a new country violated citizens’ right of participation and that of the parliamentary representatives, as the Spokesperson Bureau was convened before PPC constituted themselves as a parliamentary group. This Tuesday, the magistrates in the TC partially upheld the appeals. The content of the pro-independence forces’ agreed declaration was already suspended by the TC in December, and declared it unconstitutional and, therefore, invalid. 

The new Catalan state will be “a citizen and participative republic”, based on a presidential system, without an army but with an “Agency for Security and Defence” which would protect citizens and control the borders. These are some of the points of the first draft that ‘Constituïm’, a group made up of several professionals from different fields that has already put together previous attempts at writing a Catalan Constitution, delivered this Wednesday to the Parliament’s President, Carme Forcadell. In total, the first proposal presented up to now includes 49 articles. The draft also foresees Catalan and Aranese, a language which is spoken in the northern region of Val d’Aran, in the Catalan Pyrenees, as the only official languages of the republic, with Spanish set to have a “special status”. The text will now be sent to several groups so they can study its constitutive process. Among those reviewing the document are the different political groups in Parliament along with civil society associations such as the National Assembly of Catalonia (ANC), the Association of Municipalities for Independence (AMI) and the association promoting Catalan culture, Òmnium Cultural.

The pro-independence forces in the Catalan Parliament, governing cross-party list ‘Junts Pel Sí’ and radical left CUP, reaffirmed this Thursday the agreement to start building the Catalan Republic, which was approved by the Catalan Chamber on the 9th of November and later suspended by the Spanish Constitutional Court (TC). Both parties have supported the motion presented by CUP which aimed to relight the proposal. Thus, 71 MPs of the 135 sitting in the Parliament voted in favour, while the 11 MPs from alternative left ‘Catalunya Sí que es Pot’ have abstained. Spanish Unionist ‘Ciutadans’, Catalan Socialist Party (PSC) and Catalan People’s Party (PPC), which is the Catalan branch of the conservative and current governing party in Spain PP, voted against the motion. “We are here to do what we said we would do” stated ‘Junts Pel Sí’ MP, songwriter and anti-Franco activist, Lluís Llach. On the other hand, PPC’s Xavier García Albiol stated that the vote didn’t mean anything as “Catalonia will continue to be Spain, whether you like it or not”.

“Defending national unity” is one of the key points that current Spanish Prime Minister Mariano Rajoy established in the People’s Party (PP) proposal for reaching agreements in order to form a stable government in Spain. A national unity “which is threatened”, according to Rajoy. Besides fighting Catalonia’s push for independence, Rajoy’s proposal also includes fighting towards economic recovery, strengthening the basis of the welfare state, fighting against terrorism and reinforcing the democratic bond between citizens and politicians. PP’s leader handed over the document to anti-Catalan nationalism Ciutadans leader Albert Rivera, with whom he held a meeting today. The proposal has also been sent to Spanish Socialist Party (PSOE) leader Pedro Sánchez, who is currently attempting to form government. 

One day after the new Catalan executive was constituted, the Spanish government has announced that the State Attorney will analyse the competences of the new Catalan Ministry for Foreign Affairs, as it may violate some of the Spanish government’s functions. “We will not allow any action which could be contrary to the Constitution or to the laws, whatever it may be” warned current Spanish Government Vice President Soraya Sáenz de Santamaría. This warning comes after the Spanish Government confirmed that a report will be written analysing the taking office ceremony of new Catalan President Carles Puigdemont, during which Puigdemont didn’t mention Spain’s King nor the Spanish Constitution.

The negotiations between cross-party list ‘Junts Pel Sí’ and radical left CUP reached their deadline this Tuesday. The pro-independence forces have agreed on a 63-page proposal to start building the Catalan Republic and establish the legality of this constitutive process. Now the document will have to be validated by CUP’s base, which will gather this Sunday at the party’s General Assembly. “We are continuing with our democratic commitment” stated 'Junts Pel Sí' top member Raúl Romeva, who highlighted that they are following the “citizens’ mandate expressed in the 27-S elections”. Regarding CUP’s veto against current Catalan President Artur Mas, who is 'Junts Pel Sí's only candidate, Romeva emphasised that they “will instate a presidency rather than a president” and restated their proposal of “a collegiate presidency composed by a President of the government and three government commissions”. 

The Spanish Constitutional Court (TC) will in the end allow the plenary session to put the pro-independence declaration to vote. The TC hasn’t adopted the precautionary measures that the PPC and Ciutadans asked for in order to stop the debate on the ‘Junts Pel Sí’ and CUP agreed proposal and will allow the plenary session to vote on the roadmap towards independence proposed by ‘Junts Pel Sí’ and CUP. They pointed out that precautionary measures are only adopted in “cases of extreme urgency” and that they understand that this is not the case. However, the TC accepted the three writs of protection presented by the Catalan People’s Party, PPC, the Catalan Socialist Party, PSC, and anti-Catalan nationalism Ciutadans. The magistrates expressed this Thursday in a joint letter that the appeals have been accepted because they “transcend the concrete case” and “raise judicial matters of a relevant social repercussion, with political consequences”. Spanish Prime Minister Mariano Rajoy assured that if the pro-independence proposal is ultimately approved, the executive itself will appeal. 

The Parliament Bureau has temporarily suspended the declaration that pro-independence forces ‘Junts Pel Sí’and CUP handed over on Tuesday to start the “disconnection process”from Spain. The decision comes in response to the request of two other groups represented in the Catalan Parliament, the second most voted list in the 27-S elections, anti-Catalan nationalism Ciutadans and the Catalan Socialist Party (PSC). The Catalan People’s Party (PPC) also supported the petition but didn’t present any formal request to stop the pro-independence forces’declaration, as they haven’t constituted themselves as a parliamentary group yet. In fact, it is necessary that all the forces in the Chamber are constituted as parliamentary groups, otherwise the Parliament’s Bureau won’t be able to listen to all the spokespersons and make a definitive decision on how to proceed with the declaration.
