All the parties in the Catalan chamber except from governing cross-party list ‘Junts Pel Sí’ urged former Catalan President, Artur Mas, to appear before the Parliament over CDC irregular funding. He will have to do so after the main figures accused in the ‘Palau Case’ assured that former CDC, now renamed as the Catalan European Democratic Party (PDeCAT), received commissions from Ferrovial construction company in exchange for public contracts and with the intermediation of ‘Palau de la Música’. Indeed, Mas was head of CDC at the time when the alleged corruption took place. Pro-independence radical left CUP consider it “a fiction” to separate CDC from PDeCat and the Catalan Socialist Party (PSC) have called for Mas to quit his political career if the accusations over CDC irregular funding prove to be true.

The Spanish Parliament will finally create a committee to investigate whether the Spanish Ministry for Home Affairs plotted to discredit Catalonia’s pro-independence process. According to a police report published last July, the so-called ‘Operation Catalonia’ was launched during last Conservative People’s Party (PP) term of office, involving former Spanish Minister for Home Office, Jorge Fernández Díaz and Inspector José Villarejo, amongst many others. Indeed, Fernández Díaz will have to appear before the Committee in relation to several tapes published last June which proved how he and former Director of Catalonia’s Anti-fraud Office, Daniel De Alfonso, plotted to discredit Catalonia’s main pro-independence parties. The creation of this Committee was first requested by left wing pro-independence ERC, former liberal ‘Convergència’, now renamed as the Catalan European Democratic Party PDeCAT and the Spanish Socialist Party, but was delayed due to Fernández Díaz’s serious illness.

The Committee on Petitions of the European Parliament requested the Spanish Government to review the voting system for residents abroad. It considers the current system to imply “difficulties” and believes that it “can be improved”. The vice-president of the committee, the Conservative People’s Party MEP from the Balearic Islands Rosa Estaràs, announced that the complaint of two young Spanish people that had difficulty voting in the general elections of 2011 and in the European elections of 2014 will continue to be investigated, while awaiting explanations from the Spanish Government. In addition, the European Parliament will send a letter to the Spanish Parliament and are confident that the case will be tackled by the Foreign Affairs Committee and the European Commission.

On the 15th of October 2011 the International Committee of the Mediterranean Games (ICMG) chose Tarragona as the city to host the Games in 2017. In this way Tarragona, in southern Catalonia, culminated its quest for the event, dating back to 2007. An unexpected turn, though, has now obliged the postponement of the Games for a year. The cause of such a measure is, according to the President of the ICMG, Amar Addadi, the “financial implications” deriving from the “10 months of deadlock” over the formation of the Spanish Government, which affected the “sporting activities and the preparation of the Tarragona Games”. The organisation has only received half of the €20 million expected from sponsorship and Spanish Government arrears owed to the project total €12 million. Hence, and in light of the economic climate, the Committee has decided to postpone the event, an unprecedented measure.   

Tensions between the Spanish Socialist Party (PSOE) and the Catalan Socialist Party (PSC) over the Spanish investiture will not break their relationship, according to both parties. Seven Catalan Socialist MPs voted last Saturday against Rajoy’s reelection, breaking ranks with the main Spanish party, which abstained, and prompting sanctions against them. However, the PSOE interim leadership expressed on Wednesday its commitment to a “balanced and symmetrical” relation with the Catalan Socialists. The PSC leader, Àngel Ros, stated in similar terms that his party does not plan to change its relationship with the PSOE despite the disciplinary proceedings against the MPs that decided not to abstain. The Catalan Socialist MPs have always argued that they voted ‘no’ to Rajoy “according to their conscience”.

Catalonia’s Supreme Court (TSJC) has admitted the complaint for charges of perversion of justice and disobedience filed by Catalonia’s Public Prosecutor, José María Romero de Tejada, against the President of the Catalan Parliament, Carme Forcadell. In the lawsuit presented last Wednesday, de Tejada stated that Forcadell “despised and opposed the Spanish Constitution” by allowing the pro-independence roadmap to be put to vote last July and that she “openly disobeyed the authority” by ignoring the Spanish Constitutional Court (TC) warnings. An official has delivered this Tuesday the notification to Forcadell. The President of the Catalan Parliament has now three days to appeal.

“We will disobey and we are willing to face the consequences”, stated this Monday Catalan Socialist Party (PSC) leader, Miquel Iceta. He was referring to the PSC’s will to say ‘no’to the reinvestiture of current Spanish President Mariano Rajoy, in opposition to the Spanish Socialist Party (PSOE) position, who agreed in its federal committee this Sunday to abstain and facilitate the Conservative People’s Party (PP) to form government. “We will vote the same way as the other Socialists in the first round, but in the second one we will vote ‘no’, regardless of how the othersvote”, he assured in an interview with Catalan radio Rac1. Iceta also referred to the current relationship between PSOE and the Catalan Socialists. Although he believes that keeping the current scenario is “the best”solution, he admitted that PSOE “has the right”to reconsider the relationship with PSC.  

Catalonia’s Public Prosecutor accused Parliament’s President, Carme Forcadell, of “wrecking” the Spanish State’s territorial model established in the Spanish Constitution by allowing the pro-independence roadmap to be put to vote. In the lawsuit presented this Wednesday before Catalonia’s Supreme Court (TSJC) in accordance with Spain’s Public Prosecutor’s demands, Prosecutor José María Romero de Tejada also stated that Forcadell deliberately ignored the Spanish Constitutional Court (TC) warnings and “despised the Spanish Constitution” with her “extravagant” action. De Tejada’s complaint accuses Forcadell of “deliberately modifying the electoral mandate” that emerged from the 27-S elections, which led to a pro-independence majority in the Catalan Chamber. 

Spain’s Public Prosecutor, Consuelo Madrigal, urged Catalonia’s Supreme Prosecutor, José María Romero de Tejada, to file a complaint against Parliament’s President, Carme Forcadell. Madrigal accused Forcadell of alleged perversion of justice and disobedience for allowing the pro-independence roadmap to be put to vote in July. However, she dismissed the misappropriation of public funds, which dispels the possibility of applying criminal charges. Thus, the Catalan Supreme Court (TSJC) will be in charge of these proceedings, together with those for the 9-N symbolic vote on independence in 2014, which have to resolve whether former Catalan President, Artur Mas and former ministers Joana Ortega and Irene Rigau are liable for ignoring the TC’s resolutions and allowing the 9-N to take place.

The Catalan President, Carles Puigdemont and the Parliament’s, Carme Forcadell, received this Tuesday the notice issued by the Spanish Constitutional Court (TC) which suspends the conclusions of the Committee to Study the Constitutive Process. Four deputy clerks delivered the documents which warn that if the Parliament and the members of the Parliament’s Bureau ignore the resolution they “will be liable for responsibility, including criminal charges”. The TC also urges the Public Prosecutor to proceed with the corresponding actions against Forcadell. Last August, the TC suspended Catalonia’s pro-independence roadmap, ratified by the majority of the Parliament, claiming that the conclusions of the Committee to Study the Constitutive Process, the group responsible for designing Catalonia’s strategy towards independence, violated the Spanish Constitution. 

The Catalan Government Spokeswoman, Neus Munté warned this Tuesday that the “Spanish Constitution can’t be understood as a Criminal Code” and insisted on the Government’s commitment to “obey the democratic mandate of the 27-S Elections” and launch the pro-independence roadmap. She made these statements one day after the Spanish Constitutional Court (TC) decided to suspend Catalonia’s plan to disconnect from Spain and opened the door to applying criminal charges to the Parliament’s President, Carme Forcadell, for allowing the approval of the conclusions of the Committee to Study the Constitutive Process. According to Munté, the TC should be “a referee” in charge of settling “the constitutionality of the laws” rather than “an executor court”.
